Terms And Conditions

Your Rental Agreement with us:

Hirers are requested to read and accept these Terms and Conditions carefully and will be asked to sign the agreement before the hire can be completed. If there is anything you do not understand or do not agree with, please speak to any member of our rental staff for guidance.

Vehicle Availability:

Whilst every effort will be made to provide the exact make and model reserved, it may be likely that a similar vehicle will be offered.

Identification:

Your driving licence must be produced each and every time you hire a vehicle from us. In addition, you must produce two further means of

identification, which must include a utilities bill to you at your present address or an official letter to you at your present address. You will also be required to leave a telephone number where you can be contacted either during the day or evening.

Note: Our rental staff reserves the right to refuse your rental if you do not produce your driving licence, or for any other reason. The cost of the hire will not be refunded in this instance.

Driving Licence:

All drivers must be in possession of a current, full valid driving licence and have held a Full UK/EU licence for 2 years + UK Licence holders with the new style driving licence MUST produce both the photocard and the paper counterpart. Drivers with foreign driving licences must present their own national licence, plus an International Driving Permit (IDP) if a non-EU, EEA resident. All other drivers may drive in the UK for up to one year from commencement of residency in accordance with the current DVLA restrictions. Sight of their Passport is required for proof of entry.

Additional drivers:

In addition to the main hirer, it is possible for two other hirers to be insured to drive the vehicle, provided they meet our insurance requirements.

Fuel:

Our rental staff will note on the pre-rental check form and rental agreement, the reading of the fuel gauge. You are requested to return the vehicle with the same amount of fuel as you commenced the rental. A re-fuelling charge will be made if it is necessary to bring the level of fuel up to where it was when you took the vehicle. No refund will be given for any fuel in excess of the original reading.

Hiring period:

The hirer must collect and return the vehicle within the given hire period.

Rental times may be adjusted to suit individual hirers' requirements subject to vehicle availability

Payment:

The full cost of rental plus a damage deposit must be paid before any vehicle is released for rental. Payment may be made by credit/debit card. Payment may be made by cheque - up to the value supported by a bank cheque card and/or major credit/debit cards only.

Insurance

Hire includes comprehensive insurance for the given hire period only.

The insurance is per driver. One named driver (25-70 years old) is included in the cost of the hire – any other named drivers will incur an additional fee.

If you will be late returning, Outermotive must be advised immediately. Failure to advise may result in charges and prosecution for driving whilst uninsured and theft of the vehicle.

Insurance is for road liability and the an itself and does not cover the contents or personal belongings.

Outermotive suggests the hirer takes separate travel insurance to cover loss of belongings or personal injury of any kind.

Breakdown

Outermotive provide comprehensive RAC repair and recovery services in the unlikely event of an accident or breakdown. We will advise you of this procedure when you collect the vehicle.

Outermotive cannot be held responsible for any services provided by the RAC.

Whilst we make every effort to ensure our vehicles are in full working order – we cannot acccept liability for consequential losses or claims arising from breakdown, accident or other cause. We will however do our utmost to provide you with a replacement vehicle subject to availability.

Your responsibilities:

You must look after the vehicle and the keys to the vehicle, any replacement sets will be provided at the hirer’s expense.

You must always lock the vehicle when you are not using it, and use any security device fitted to or supplied with the vehicle.

You must always protect the vehicle against bad weather, which can cause damage.

You must make sure that you use the correct fuel, as you are responsible for any resultant damage.

You must not sell, rent, or dispose of the vehicle or any of its parts.

You must not give anyone any legal rights over the vehicle.

You must not let anyone work on the vehicle without our permission. If we do give you permission, we will only give you a refund if you have a receipt for the work.

You must let us know as soon as you become aware of a fault in the vehicle.

What to do if you have an incident:

If you have an incident you must not admit responsibility. You should get the names and addresses of everyone involved, including

witnesses. You should also:

Make the vehicle secure.

Tell the police straight away if anyone is injured or there is disagreement over who is responsible; and

Call our office straight away.

You must then fill in our incident report statement when you return the vehicle or if this is not possible, verbal details will be taken from you to then sign a copy of the information you have supplied. In any event this procedure must be actioned within 24 hours whichever is sooner.

In the event of any police involvement the hirer is expected to provide full cooperation with the enquiries.

Any damage sustained to the interior or exterior of the vehicle or to any equipment supplies for hire will be at cost to hirer.

No claim by the hirer will be considered in respect of loss or damage to personal belongings of the hirer or any persons connected with the hirer.

Conditions for using the vehicle / Road Restrictions / Weather Conditions

Only you or a named driver on the insurance may drive the vehicle providing a full valid driving licence is held.

All vehicles may only be driven on sealed / bitumen roads.

Outermotive reserves the right at any time at it’s sole discretion, to restrict vehicle movements in certain areas due to adverse road or weather conditions or any other reasonable cause.

Outermotive cannot be held responsible for any early return or claim due to adverse weather conditions.

The hirer is responsible for any damage to the vehicle or accessories due to adverse weather especially where there is a ‘weather warning’ in place.

You or your authorised named driver must not:

Use the vehicle for hire or reward.

Use the vehicle for any illegal purpose.

Use the vehicle for racing, pace making, testing the vehicle’s reliability and speed or teaching someone to drive.

Use the vehicle while under the influence of alcohol or drugs

Drive the vehicle outside England, Scotland and Wales, unless we have given you written permission.

Load the vehicle beyond the manufacturer’s maximum weight recommendations and make sure that the load is secured safely.

If the vehicle is a commercial vehicle, use it for a purpose for which you need an operator’s licence if you do not have one.

Use the vehicle for towing unless we have given you written permission.

Carry more passengers than the seating capacity of the vehicle or allow it to become overloaded.

Returning rental vehicles:

Before you bring back the vehicle you must check that you have not left any personal belongings in the vehicle. Vehicles must always be

returned back to us during opening hours. We will not accept responsibility for vehicles damaged or stolen from outside our premises if dropped-off after hours. If we have agreed that you may return the vehicle outside business hours, you will remain responsible for the vehicle and its condition until it is re-inspected by a member of our staff.

If you do not bring the vehicle back on time you are breaking the conditions of this agreement. We can charge you for every day you have the vehicle after you should have returned it to us. Until we get the vehicle back we will charge you the daily rate you have rented the vehicle at plus any costs due to compensation or loss of hire to the next hirer.

Early return will not result in a refund for the remaining days of the hire period.

Pre-inspection condition / Mileage

A visual check (inside and out) shall be made with the hirer at the time of collection as to the general condition of the vehicle.

At this point the hirer agrees that the vehicle is in good running order and clean.

All our vehicles are designated non-smoking vehicles – this includes inside any awning supplied by Outermotive.

It is the hirer’s responsibility to exercise reasonable care of the vehicle during the hire period – this includes maintaining the correct tyre pressures and correct level of engine oil – failure to do so may result in engine damage for which the hirer will be responsible for.

Tyre damage of any kind is the hirer’s responsibility.

If on return the hirer has covered more than 1000 miles, a one off standard charge of £75 will be made to cover the extra vehicle service that is required.

 

You will have to pay for reasonable costs of repair if:

-We have to pay extra costs to return the vehicle to its condition when the pre-rental inspection was carried out (for example, if extra valeting

time or special material or equipment is needed to restore the vehicle to its pre-rental condition).

-The vehicle has been damaged whilst in your care.

Deposits / Cancellations / Refunds

A security deposit will be taken and held for the duration of the hire period.

The deposit will be £500 in the form of cash, cheque or credit card swipe.

Security deposits will be returned in full provided the vehicle is returned clean and tidy with full inventory, without damage, on time and with the agreed amount of fuel.

Refunds will be made within 24 hours of the return of the vehicle following cleaning and inspection.

If a booking is cancelled within 28 days of the start of the hire period there will be no refund of the hire fee.

In the event of cancellation by Outermotive:

Outermotive will offer a full refund if a vehicle reserved or a similar vehicle to that reserved is not available due to accident, breakdown or other circumstances beyond our control. In this event the hirer shall have no other claim of any kind against Outermotive. You are advised to take out holiday insurance to cover these eventualities.

Charges:

We work out charges using our current price list.

You will pay the following charges:

The rental and any other charges we work out according to the agreement.

Any charge for loss or damage due to you not keeping to your responsibilities.

A refuelling service charge if you have used, and not replaced, the quantity of fuel that we supplied at the start of the rental.

All fines and court costs for parking, traffic, or other offences (including any costs which arise if the vehicle is clamped). You must pay the appropriate authority any fines and costs if and when the authority demands this payment. If you do not, you will be responsible to pay our reasonable administration charges, which arise when we deal with these matters on your behalf. A loss-of-income charge, when we demand it, if we cannot rent out the vehicle because it needs to be repaired or it is a write-off (can’t be repaired).

Any published rates for delivering and collecting the vehicle.

Interest which we will add every day to any amount you do not pay us on time, at the rate of 4% a year above the base lending rate of Barclays

Bank PLC.

Value Added Tax and all other taxes on any of the charges listed above, as appropriate.

You are responsible for all charges, even if you have asked someone else to be responsible for them.

Ending the agreement:

If you are an individual, we will end this agreement straight away if we find out your belongings have been taken away from you to pay off your debts, or a receiving order has been made against you. We may end this agreement if you do not meet the main requirements of this agreement. If you are a company, we will end this agreement straight away if:

You go into liquidation.

You call a meeting of creditors.

We find out that your goods have been taken away from you until you pay off your debts.

or you do not meet any of the conditions of this agreement.

If we end this agreement it will not affect our right to receive any money we are owed under the conditions of this agreement. We can also claim reasonable costs from you if you do not meet the main requirements of this agreement. We can repossess the vehicle (and charge you a reasonable amount) without using unreasonable force or causing damage.

Data Protection:

You agree that we may use any information you have given us to carry out our own market research. If you break the agreement we can give this information to credit reference agencies, the Driver and Vehicle Licensing Authority (DVLA), debt collectors and any other relevant organisation. We can also give this information to our Insurance Brokers who may inform the British Vehicle Rental and Leasing Association (BVRLA), who can pass it on to any of its members for any purpose shown in the Data Protection Act 1998.

Governing law:

The laws of the country in which it is signed govern this agreement. Any dispute may be settled in the courts of that country.

Severance

If any provision of this Agreement is held invalid, illegal or unenforceable for any reason by any Court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if this Agreement had been agreed with the invalid illegal or unenforceable provision eliminated.

Outermotive reserves the right to vary the rates, terms and conditions of hire, and to refuse hire to any person without explanation or prior warning.

NOTE:

Exclusion for loss or damage if the insured vehicle is taken, or driven, by any person who is not an insured driver but is a member of the insured driver’s or hirer’s family or household.

You must keep your vehicle and its keys safe at all times for a claim to be valid. You must ALWAYS close the doors, windows and lock the vehicle removing the keys. Failure to do so may result in a claim for theft being refused.

1) The Insured shall verify the identity and permanent address of the Hirer and any other permitted driver by means other than relying solely on the information contained in the Hirer’s or driver’s driving licence and that such person is not amongst the excluded persons enumerated below.

2) I Agree that none of the following categories apply to myself as hirer or any named drivers I have given

a) Hirers aged 25 or over unless a full driving licence valid in the United Kingdom has been held for 2 years

b) Persons who have been convicted of an offence in connection with the driving of a motor vehicle or motorcycle and/or have had their driving licence endorsed or suspended or penalty points imposed. Parking and not more than two speeding offences in the past 3 years may be ignored. “Spent” convictions, covered by the Rehabilitation of Offenders Act 1974 may be disregarded.

c) Persons who have any mental or physical defect or infirmity or suffers from fits, diabetes or any heart complaint.

d) Persons who have had their insurance declined and/or renewal refused and/or special insurance terms imposed as a result of claims experience and/or have had their insurance or cover cancelled by any Motor Insurer.

e) Persons engaged wholly or partly in professional entertainment or professional sports persons.

f) Jockeys and persons connected with racing of any sort.

g) Undergraduates and/or students under 25 years of age.

h) Persons who, whilst driving, have been involved in more than one accident during the past 3 years.

Foreign Service Personnel other than persons born in the United Kingdom.
